PURCHASE PROPOSAL AND CONCLUSION OF THE CONTRACT.

These conditions of sale may be subject to changes and updates by AOX Italia at any time, and the buyer undertakes to read them before placing any order. The reference legislation for distance contracts is found in Section II of Italian Legislative Decree No. 206 of 6 September 2005. The contract will be concluded through the user/buyer accessing the website www.aox.com.

Here, following the specified procedure, they will formulate the proposal to purchase the products. The contract is concluded at the time of AOX Italia's acceptance of the order, which will be notified to the buyer by email. By submitting the order, the user implicitly declares that they have read and understood all the information present during the purchase procedure and that they fully accept the general conditions contained on this page. If it does not accept the order, AOX Italia undertakes to notify the buyer in a timely manner. Once the user has formulated the online purchase proposal, they will print, download and save an electronic copy or keep these general conditions of sale as required by Italian Legislative Decree No. 206/2005. Any right the buyer has to compensation for damages or indemnity is denied, and any contractual or extra-contractual liability is excluded for any direct or indirect damage to persons and/or property due to non-acceptance or fulfilment, in whole or in part, of the order. All communications addressed to AOX Italia must be made exclusively to the physical address specified on this page or by email.

1. PRICES AND METHOD OF PURCHASE IN ITALY..

Purchase proposals on the site www.aox.com must be made exclusively by adult users resident or domiciled in Italy and in possession of a regular tax code. The prices of the products indicated on the site www.aox.com, which constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code, are inclusive of VAT and all other taxes. The sale prices are valid until the notification of acceptance of the purchase proposal is received. The images/photos of the products on the site are for illustrative purposes only. If specific indications are missing in the order notes, there will be no right to complain about the purchase's lack of conformity. By sending their purchase proposal, the buyer gives their consent to AOX Italia using the means of fax, phone and email.

2. METHOD OF PAYMENT.

The buyer can pay for the products ordered using the following payment methods (always indicated online at the payment step of the purchase process):

a) PayPal If PayPal is chosen as the payment method, the transaction will take place on a server owned by PayPal. It can be finalised by the customer by debiting their PayPal account or through a transaction made via credit card, by filling in the fields of the appropriate form on the payment screen. Any problems verifying the aforementioned transaction will not be imputable to AOX Italia, which makes itself available to provide the necessary assistance to resolve the problem.

b) Bank transfer in advance and made out to AOX Italia The payment is made by bank transfer. AOX Italia's IBAN details are sent to the customer via the email address they provided during the purchase process, once they have chosen the payment method. For security and to shorten shipping times, the customer is asked for a fax copy or scan of the transaction receipt. c) Credit card If credit card is chosen as the payment method, the transaction will take place on a server owned by Afone. It can be finalised by the customer through a transaction made via credit card, by filling in the fields of the appropriate form on the payment screen. Any problems verifying the aforementioned transaction will not be imputable to AOX Italia, which makes itself available to provide the necessary assistance to resolve the problem.

c) Cash on delivery If cash on delivery is chosen as the payment method, the amount due must be paid to the Courier upon delivery of the goods. In this case, a €4.00 supplement will be applied to the total due to cover administration costs. At the time of delivery, the customer is always required to collect the package regardless of the condition it is in. If it is damaged, the customer can sign with reservation, accept the package and contact us immediately at info@aox.com. Regardless of the package's condition, failure to collect it will result in the customer being obliged to pay the shipping costs, equal to €4.90, which can be paid by bank transfer or credit card. Refusal to pay this amount will constitute grounds for legal complaint.

3. PRODUCT AVAILABILITY.

If an order contains a number of products greater than the quantity of product available in stock in our warehouse, AOX Italia guarantees to fulfil the order, in the shortest possible time and in the quantities indicated by the buyer. If it is not possible to find the missing quantity of product, AOX Italia, subject to duly notifying the buyer and obtaining their express consent, undertakes to replace the missing product with a similar one in terms of formulation and desired effects. If the buyer does not accept the replacement product and a longer time for completing the order (in any case not exceeding the 30 days set out by Article 54 of Italian Legislative Decree No. 206/2005), AOX Italia will ship the ordered goods in any case, provided that the value of the order is greater than or equal to €50.00 (fifty euros). If the buyer does not give their consent to wait the time necessary for delivery (more than 30 days as required by Article 54 of Italian Legislative Decree No. 206/2005) and if the residual value of the order placed is not equal to or greater than €50.00 (fifty euros), the contract will be considered terminated and AOX Italia will immediately cancel the order. Before placing an order for products that are difficult to find, it is advisable to send an email to info@aox.com in order to avoid unwelcome inconvenience.

4. DELIVERY METHODS AND COSTS.

AOX Italia undertakes to have the ordered products delivered to buyers by the couriers and/or shippers of its choice. Shipping takes place from Monday to Friday; holidays, Saturdays and Sundays are excluded. The products are delivered within 24 or 48 hours from when the order is concluded, except for Sardinia and the smaller islands, where a delivery time of 96 hours should be expected. Upon notification of payment, the products will be prepared for shipping. AOX Italia undertakes to promptly notify the buyer of stock errors or difficulties finding products no longer on the market. In this case, it undertakes to return the entire sum received including shipping costs. At the time of shipment, the buyer will be sent an email notification to let them monitor the purchased goods until these arrive at their home. Upon delivery, the buyer is required to check that the packaging is in good condition. If it is not, they are authorised not to accept it; furthermore, if equipped with a camera, they can photograph it, thus certifying the actual condition of the packaging at the time of delivery. In the following hours, they will be required to inform AOX Italia, either by phone or by writing to info@aox.com, which will resolve the problem as soon as possible.

5. OBLIGATIONS OF THE BUYER..

It is naturally forbidden for the buyer to provide false and/or fictitious data in the registration procedure for the execution of this contract and the communications related to it; personal data and email addresses must be strictly real and not belong to third parties or fictitious people. AOX Italia reserves the right to legally pursue any violation in this sense and any abuse, in the interests and for the protection of all consumers. The buyer relieves AOX Italia from any liability arising from the issue of incorrect tax documents due to errors in the data provided by the buyer, the latter being solely responsible for entering it correctly on the site. The buyer is obliged to accept the jurisdiction of the Court of Forlì-Cesena for any disputes relating to the application, execution, interpretation and violation of this contract.

6. DATA COLLECTION AND PROCESSING..

By filling in the personal data form in the registration procedure necessary to activate the process of completing this contract and further communications related to it, the buyer authorises AOX Italia to provide their non-sensitive personal data (residence, phone number) to the trusted couriers and/or freight forwarders used to ship the purchased products in order to deliver orders. The aforementioned data is processed electronically in compliance with the laws in force and may be shown only at the request of the judicial authority or other authorities authorised for this purpose by law. Personal data will be communicated only to those delegated to carry out any activity necessary to execute this contract and will be disclosed exclusively for this purpose. Personal data is processed, including through electronic means, in compliance with the procedures established by Article 11 of Italian Legislative Decree No. 196 of 30 June 2003 to guarantee consumers and protect their rights, fundamental freedoms and dignity, with particular reference to confidentiality and the protection of personal identity. The data processing will be carried out for the period of time necessary to fulfil this contract. Personal data will not be disclosed to third parties. The user can request the erasure of their personal data by sending a fax or letter to the Pharmacy office specified on this page. 7. WARRANTIES AND METHODS OF ASSISTANCE.

The warranty clauses on this page replace any other warranty or condition, other than those provided by law. Pursuant to Italian Legislative Decree No. 24/02, all products marketed by AOX Italia possess the manufacturer's conventional warranty and the 24-month warranty for lack of conformity. To take advantage of the warranty, the buyer must keep the invoice or transport document received at the time the goods were delivered. The manufacturer's warranty is provided in accordance with the terms and conditions set out in the documentation included in the packaging of the product subject to the warranty or assistance request. The 24-month warranty applies, as defined by Italian Legislative Decree No. 24/02, to a product that has a lack of conformity, provided it has been used correctly, in compliance with its intended use and everything specified in the attached technical documentation. In the event of lack of conformity, AOX Italia will replace the product at no cost to the buyer. If it is not possible for us to replace the product under warranty for any reason, AOX Italia may, upon notifying the buyer, send them a product with the same characteristics and value or issue a discount coupon for the same amount, which can be spent within 6 months on another item for sale on the site. This warranty is transferable only if the current owner provides the original proof of purchase issued by AOX Italia. In countries where the limitation of liability is not precluded, AOX Italia's maximum liability may in no case exceed the amount paid by the buyer to purchase the product, except in cases of wilful misconduct or gross negligence. AOX Italia accepts no responsibility for incidental, special, indirect or consequential damages, except in cases of wilful misconduct or gross negligence. Any manufacturing defects must be reported within two months of their discovery, under penalty of forfeiture in accordance with Article 1519-sexies of the Italian Civil Code. The buyer must make a specific complaint following the procedure indicated in point no. 9.

8. RIGHT OF WITHDRAWAL..

Information on exercising the right of withdrawal A. Standard instructions on withdrawal pursuant to Article 49, paragraph 4, of Italian Legislative Decree 206/2005. Right of withdrawal You have the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, come into physical possession of the goods. In the event of a return or exchange of a product, you will bear the shipping costs. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post, fax or email). Effect of withdrawal If you withdraw from this contract, you will be refunded for all payments you have made to us, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not have to incur any costs as a consequence of this refund. Please send the goods back or deliver them to us without undue delay and in any case within 14 days from the day on which you announced your withdrawal from this contract. To comply with this deadline, you must send the goods back before the 14-day period expires. The direct costs of returning the goods will be at your expense. You are only responsible for any decrease in the goods' value which results from them being handled in a way other than that necessary to establish their nature, characteristics and functioning.

9. COMPLAINTS..

Any complaints must be forwarded through the form found in the "Complaints" section, all the fields of which must be completed. The buyer will receive an email confirming the opening of the complaint procedure within three working days. The same email will provide all the instructions for defining the procedure and specify any requests for clarification or documentation to support the complaint. As per current legislation, if more than six months have elapsed from the delivery of the product, the buyer must provide suitable documentation certifying and providing certain proof that the lack of conformity already existed at the time of delivery, and not later. For any complaints submitted within six months of delivery, AOX Italia reserves the right to verify the actual presence of the claimed defect, before proceeding with the solution requested by the buyer or the alternative solution provided by law.

10. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE..

AOX Italia has the right to terminate the contract on this page by giving the buyer appropriate notice and specifying the reasons. In this case, the buyer will only be entitled to a refund of the amount, if already paid. The fact that the payment is successful, made by the customer through one of the payment methods provided on this site and explained in point 2 of these conditions, and the obligations assumed by the buyer, are essential. Therefore, the buyer's non-fulfilment of even just one of the obligations specified on this page will result in the legal termination of the contract as established by Article 1456 of the Italian Civil Code, without the need for a judicial decision, and without prejudice to AOX Italia's right to take legal action for compensation for any further damages. 11. JURISDICTION AND COMPETENT COURT. Any disputes relating to the application, execution, interpretation and violation of purchase contracts stipulated online through this website are subject to Italian jurisdiction. With the exception of the cases provided for by Article 63 of Italian Legislative Decree 206/2005, any dispute between the parties regarding the application, execution, interpretation and violation of the contract on this page will fall under the exclusive competence of the Court of Forlì-Cesena.
